1. General Provisions

These Terms of Service ("Terms") govern the use of the Tilki Öğretmen platform ("Platform", "Service") operated by Tilki App - Mehmet Nuraydın ("Tilki", "We", "Our") through tilki.app and related subdomains.

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, please do not use the Platform.

2. Service Description

Tilki Öğretmen is a management platform developed for private tutors. Our Service includes the following features:

  • Student and lesson management
  • Lesson plan creation and tracking
  • Payment tracking and financial reporting
  • Parent communication panel
  • Automated reminder and notification systems
  • Calendar and scheduling tools
  • Reporting and analytics tools

The Platform enables teachers to manage their tutoring business from a single interface and aims to reduce administrative workload.

3. Account Creation and User Responsibilities

3.1. Account Registration Requirements

You must create an account to use the Platform. When creating an account:

  • You must be at least 18 years of age
  • You must provide accurate, current, and complete information
  • You must keep your account information up to date
  • You must ensure the security of your Google account (sign-in is done via Google OAuth)
  • You are responsible for the security of your account

3.2. Account Security

To maintain the security of your account:

  • Do not share your Google account credentials with anyone
  • Immediately notify us if you notice unauthorized access to your account
  • You are responsible for all activities that occur under your account
  • You may not allow others to use your account credentials

3.3. Prohibited Activities

When using the Platform, the following activities are prohibited:

  • Providing false, misleading, or fraudulent information
  • Gaining unauthorized access to other users' accounts
  • Compromising Platform security
  • Uploading malware, viruses, or malicious code
  • Using the Platform for illegal purposes
  • Spam, phishing, or fraudulent activities
  • Violating intellectual property rights
  • Copying or distributing Platform content without permission
  • Harassing or disturbing other users

4. Subscription and Payment Terms

4.1. Trial Period

New users are offered a 30-day free trial. During the trial period:

  • Full access to all features is provided
  • No credit card information is required
  • There is no automatic conversion to paid subscription at the end of the trial
  • You may cancel at any time

4.2. Pricing

To continue using the Service after the trial period, a paid subscription is required:

  • Per Active Student: 150₺/month/active student
  • Monthly billing - no annual plans available
  • Prices include VAT
  • Payments are automatically renewed
  • Invoice amount is calculated based on the number of active students during the billing period

4.2.1. Active Student Definition

For accurate billing calculation, an "active student" is defined as follows:

  • Students registered with "active" status on the Platform are included in billing
  • Archived (inactive) students are excluded from billing
  • When a student is added or archived, the change is reflected in the next billing period
  • Billing is independent of whether the student attends lessons - active registration is the determining factor

4.3. Payment Methods

Payment processing is conducted through our authorized payment service provider Paddle (Merchant of Record). Payment methods accepted through Paddle include:

  • Credit card (Visa, Mastercard, American Express)
  • Debit card
  • Other local payment methods supported by Paddle

Payment transactions are processed through Paddle's secure infrastructure. Your credit card information is not stored in our systems. Paddle handles tax calculation, invoice generation, and payment security during the payment process.

4.4. Automatic Renewal

Your subscription will automatically renew each month unless cancelled:

  • Invoice amount is calculated based on the number of active students at the renewal date
  • Renewal is notified via email 3 days in advance
  • If payment fails, a 7-day grace period is granted
  • If payment is not received after the grace period, the account is suspended

4.5. Cancellation Terms

You may cancel your subscription at any time:

  • Cancellation can be done through account settings or by contacting us
  • After cancellation, you will continue to have access to the Service until the end of the current billing period
  • Cancelled subscriptions are automatically terminated at the end of the period

4.6. Refund Policy (14-Day Money-Back Guarantee)

Your satisfaction is important to us. The following refund terms apply:

  • 14-Day Money-Back Guarantee: If you are not satisfied within 14 days of your first payment, a full refund will be issued with no questions asked
  • You may submit your refund request by sending an email to mehmet@tilki.app
  • Refunds are processed within 5-10 business days to your original payment method
  • Refunds are processed through the Paddle payment infrastructure

After 14 days:

  • No refunds are provided for cancellations made after the 14-day refund period
  • You will continue to have access to the Service until the end of the current period
  • Partial period refunds are not provided

4.7. Price Changes

Tilki reserves the right to modify subscription fees:

  • Price changes will be notified at least 30 days in advance
  • Changes do not affect the current billing period
  • New pricing applies upon renewal
  • If you do not accept the price change, you may cancel your subscription

5. Data Usage and Privacy

For detailed information about how your personal data is collected, used, and protected, please review our Privacy Policy.

By using the Platform:

  • You consent to the processing of your personal data
  • You represent that you have the legal authority to collect and process student data
  • You commit to complying with KVKK (Turkish Personal Data Protection Law) and GDPR regulations
  • You are responsible for the accuracy and currency of the data you store on the Platform

6. Intellectual Property Rights

6.1. Platform Ownership

The Platform and all its content (software, design, logos, text, graphics, code) are the exclusive property of Tilki and are protected by intellectual property laws.

6.2. Usage License

The license granted to you is:

  • Limited: For personal commercial use only
  • Non-transferable: May not be transferred or sublicensed to others
  • Non-exclusive: Licenses are also granted to other users
  • Revocable: May be revoked in the event of violation of these Terms

6.3. User Content

Content you upload to the Platform (student information, lesson notes, etc.):

  • Belongs to you and your ownership rights remain unchanged
  • You grant Tilki only a limited license necessary to provide the Service
  • You are responsible for ensuring that the content is legal and accurate
  • You may not upload content that infringes copyright

7. Service Interruptions and Changes

7.1. Service Interruptions

The Platform is provided "as is" and interruptions may occur due to:

  • Scheduled maintenance (notified in advance)
  • Emergency security updates
  • Technical failures and system errors
  • Internet service provider issues
  • Force majeure events (natural disasters, war, etc.)

Scheduled maintenance is notified at least 24 hours in advance and is generally performed during low-usage hours.

7.2. Service Changes

Tilki may, without prior notice:

  • Modify, add, or remove Platform features
  • Update the user interface
  • Modify APIs and integrations
  • Adjust service limits and quotas

8. Disclaimer of Warranties and Limitation of Liability

8.1. Disclaimer of Warranties

The Platform is provided "as is" and "as available." Tilki makes no express or implied warranties:

  • No warranty is provided that the Service will be uninterrupted, secure, or error-free
  • No warranty is provided that the Platform will be accessible at all times
  • No warranty is provided that errors will be corrected
  • No warranty is provided that you will achieve particular results

8.2. Limitation of Liability

To the extent permitted by law, Tilki is not liable for:

  • Data loss or damage
  • Loss of revenue or business opportunities
  • Indirect, incidental, or consequential damages
  • Disruptions in third-party services
  • Unauthorized access or data breaches
  • Any damages arising from use of the Platform

Tilki's total liability shall not exceed the subscription fees you paid in the last 12 months.

8.3. User Responsibility

You are solely responsible for:

  • Backing up all data you enter into the Platform
  • Legally collecting student and parent data
  • Compliance with KVKK and GDPR
  • Your account security
  • All transactions performed through the Platform

9. Account Suspension and Termination

9.1. Termination by User

You may close your account at any time:

  • By using the "Close Account" option in account settings
  • Or by sending an email to mehmet@tilki.app
  • Your data will be deleted within 30 days after account closure
  • Fees paid for the current billing period are not refundable (unless within the 14-day refund period)

9.2. Termination by Tilki

Tilki may suspend or terminate your account in the following circumstances:

  • Violation of these Terms of Service
  • Illegal activities
  • Payment failure (after the 7-day grace period)
  • Behavior that threatens Platform security
  • Causing harm to other users
  • Providing false or misleading information

In the event of account closure:

  • Your Platform access will be immediately terminated
  • You have the right to download your data within 30 days
  • No refund is provided for the remaining subscription period (except in cases of payment failure)

10. Third-Party Services and Integrations

The Platform is integrated with the following third-party services:

  • Google Calendar: Lesson calendar synchronization
  • Google Meet: Creating online lesson links
  • Zoom: Creating online lesson links
  • WhatsApp Business API: Parent notifications (lesson reminders, payment notifications, teacher notes)
  • Paddle: Payment processing and subscription management (Merchant of Record)
  • OpenRouter: Language model access for AI assistant features
  • PostHog: Product analytics and usage statistics
  • Meta/Facebook Pixel: Advertising performance tracking

By using these integrations:

  • You agree to the terms of service and privacy policy of the relevant third-party service
  • Tilki is not responsible for interruptions or errors in third-party services
  • Integrations may be modified or removed at any time

11. Dispute Resolution

11.1. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey.

11.2. Jurisdiction

For all disputes arising from or relating to these Terms, the Courts and Enforcement Offices of Istanbul shall have exclusive jurisdiction.

11.3. Dispute Resolution Process

If you experience any issues:

  2. Explain your issue in detail
  3. We will respond within 5 business days
  4. If no resolution is reached, you may pursue the legal remedies stated above

12. Amendments and Updates

Tilki reserves the right to modify these Terms of Service at any time:

  • Material changes will be notified via email
  • Minor changes will be announced on the Platform
  • Changes take effect 30 days after notification
  • If you do not accept the changes, you may close your account
  • Continued use of the Platform after changes take effect constitutes acceptance of the new terms

The "Last Updated" date is indicated at the top of this page.

13. Miscellaneous Provisions

13.1. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.2. Waiver

Tilki's failure to exercise any right under these Terms does not constitute a waiver of that right.

13.3. Assignment

You may not assign your rights and obligations under these Terms to another party. Tilki may assign these Terms without prior notice.

13.4. Entire Agreement

These Terms of Service and the Privacy Policy constitute the entire agreement between you and Tilki and supersede all prior oral or written agreements.

13.5. Language

In the event of any inconsistency between different language versions of these Terms, the Turkish version shall prevail.

15. Acknowledgment and Acceptance

By using the Platform or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, please do not use the Platform and close your account immediately.
